“I am not here to protect the rights of children.”
“Don't come to me with those Conventions. I don't agree with them." (Referring to the Convention on the Rights of the Child, Convention on the elimination of all forms of discrimination against women, Inter-American Convention to prevent, punish and eradicate violence against women "Convention of Belem Do Pará", among others) .
“He is the father that you chose for your children. What he wants? He has the right to see them.” (Alluding to a man who received a complaint for family violence).
"I understand that he appears violent in court, the Lord against whom a measure of prohibition of approaching his children was decreed."
All these phrases are pronounced lightly by some of our judicial operators of the Family Jurisdiction. Yes, even if it sounds improbable, those words are the ones that women victims of violence are often condemned to hear. Those same women who, going through one of the greatest difficulties, access to justice, and having been encouraged to denounce the violence suffered, must bear to hear these disconcerting expressions from the mouths of those who have the obligation to protect them. What greater lack of protection can there be than to verify that those to whom they turn in search of protection and justice give them such answers? The only thing that can become part of reparation for those women is that those who are in charge of the power to resolve cases in which they are complainants, listen to them, believe them, protect the rights that assist them with a gender perspective and take the necessary measures to avoid increasing the danger to which they and their children are exposed. The judicial system welcomes women victims of violence without taking into account the entire process they are going through, without putting itself in their place, causing them greater suffering instead of making them feel protected, which inexorably leads to a new victimization, that exposes the misunderstanding of gender violence from a comprehensive perspective by those in charge of applying the laws. We are aware of this situation and for this reason, from Shalom Bayit we accompany women by providing legal sponsorship to defend their rights, and to face any situation that even from the courts tries to violate them. The response of justice should never be a new grievance. Our commitment is to try to avoid it.
